Fickle App LLC ("Fickle," "we," "us," or "our") respects intellectual-property rights and expects users of FickleApp.com and related services (the "Services") to do the same. This Copyright & DMCA Policy explains ownership of Fickle materials and the process for reporting alleged copyright infringement.
1. Fickle Copyright and Proprietary Rights
Except for User Content and third-party materials, the Services and original materials made available by Fickle—including software, code, site and application design, user-interface elements, graphics, text, photographs owned by Fickle, videos, databases, compilations, logos, icons, tournament-management workflows, and other original content—are owned by or licensed to Fickle App LLC and are protected by U.S. and international copyright, trademark, trade-secret, and other intellectual-property laws.

Nothing in this policy transfers ownership of Fickle intellectual property. Permission to use the Services is governed by the Fickle Terms of Service.
2. Trademarks
Fickle, FickleApp, FickleApp.com, associated logos, product names, slogans, and trade dress may be trademarks or service marks of Fickle App LLC. You may not use Fickle branding in a manner that falsely suggests sponsorship, endorsement, affiliation, or ownership. The absence of a trademark symbol does not constitute a waiver of rights.
3. User Content
Users retain ownership of copyright they hold in content they submit to the Services. By submitting content, users grant Fickle the license described in the Terms of Service so that Fickle can host, display, process, distribute, secure, and operate the Services.
Users may not upload or distribute content that infringes another person's copyright or other intellectual-property rights.
4. Reporting Copyright Infringement
If you believe copyrighted material is being infringed on or through the Services, you may submit a written notice under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, to Fickle's designated copyright contact listed below.
To be effective, a DMCA notice should include substantially all of the following: (1) the physical or electronic signature of a person authorized to act for the owner of the exclusive right allegedly infringed; (2) identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at one online site are covered; (3) identification of the material claimed to be infringing and information reasonably sufficient to allow Fickle to locate it; (4) information reasonably sufficient to allow Fickle to contact the complaining party, such as name, mailing address, telephone number, and email address; (5) a statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or law; and (6) a statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner of the exclusive right allegedly infringed.

6. Fickle Response to Notices
When Fickle receives a substantially compliant infringement notice, Fickle may remove or disable access to the identified material, notify the affected user, request additional information, or take other steps appropriate under applicable law.
Fickle may forward a copy of the notice, including the complaining party's contact information, to the user who posted the challenged material or otherwise disclose it as necessary to administer the notice-and-takedown process.
7. Counter-Notification
If material you posted was removed or disabled because of a DMCA notice and you believe the removal resulted from mistake or misidentification, you may send a counter-notification to the contact above.
A counter-notification should include substantially all information required by 17 U.S.C. § 512(g), including: (1) your physical or electronic signature; (2) identification of the material removed or disabled and the location where it appeared before removal; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (4) your name, address, and telephone number, together with the legally required statement consenting to jurisdiction of the appropriate U.S. federal district court and accepting service of process from the person who submitted the original notice or that person's agent.
After receiving a valid counter-notification, Fickle may restore the material in accordance with the timing and procedures established by the DMCA unless the original complaining party provides notice of a qualifying court action.
8. Repeat Infringers
Fickle may, in appropriate circumstances and at its discretion consistent with applicable law, suspend or terminate accounts of users who repeatedly infringe copyrights or other intellectual-property rights. Fickle may also limit access or remove content when infringement is apparent or properly reported.
9. Misrepresentations
Knowingly materially misrepresenting that material is infringing, or that removed material was removed by mistake or misidentification, may result in liability under applicable law. Parties should consider whether a use is authorized by the copyright owner or protected by law, including fair use, before submitting a notice or counter-notification.
10. Permission Requests
Requests to reproduce, license, publish, or commercially use Fickle-owned content outside the permissions granted by the Terms of Service may be sent to FickleApp1@gmail.com. Permission is not granted unless Fickle provides written authorization.
11. Other Intellectual-Property Complaints
Claims concerning trademarks, impersonation, counterfeit goods, trade secrets, or other intellectual-property rights may be sent to FickleApp1@gmail.com with enough information for us to understand and evaluate the complaint. Fickle may request proof of ownership or authorization.
12. Changes to This Policy
We may update this Copyright & DMCA Policy from time to time. The revised policy will be posted with an updated revision date.
